EU consumer and marketing law : public consultation

The European Commission published the outcome of its Fitness Check of EU consumer and marketing law and the evaluation of the Consumer Rights Directive. It will now gather stakeholders' views on possible legislative changes via an open public consultation.

The evaluation shows that EU consumer law remains largely fit for purpose. When applied effectively, the existing rules tackle the problems that European consumers are facing today, also online. Findings point to the need to improve awareness, enforcement of the rules and redress opportunities to make the best of the existing legislation.

The evaluations also show that it could be beneficial to make some targeted adjustments to some of the existing Directives, in particular with a view to:

- Enhance transparency on with whom consumers conclude contracts when buying on online marketplaces and whether EU consumer rights are applicable to such contracts

- Extend to "free" online services the same rights to pre-contractual information and to withdraw within 14 days

- Grant individual remedies to consumers harmed by unfair commercial practices, for example misleading green claims

- Make penalties for breaches of consumer laws more proportionate, effective and deterrent across the EU

- Simplify some rules and requirements

The Commission is now seeking companies' views on possible targeted legislative changes in some key EU consumer law directives.
